Terms
These terms apply to the use of Mermaid nao’s services. They are here so that you can commission a piece with peace of mind, so please read them before applying.
Article 1 (Scope)
These terms set out the conditions for using Personal Order Art, Business Art, the creation and sale of original artworks, exhibitions, speaking engagements, media appearances, and other services provided by Mermaid nao (“I” or “the artist”) (the “Services”). By applying, you are deemed to have agreed to these terms.
Article 2 (Nature of the artwork)
Each artwork is a made-to-order original created by the artist based on a hearing through conversation. Because of the nature of the work, I cannot accept requests specifying motifs, composition, or the finished image. I will carefully ask about colors, mood, and where it will hang during the hearing.
Article 3 (Fees, payment, and delivery)
Fees, payment methods, payment timing, and the timing of delivery are as set out in the Legal Notice (Act on Specified Commercial Transactions) page. Listed prices include consumption tax, domestic shipping, framing, and credit card fees. Prices, availability, delivery times, and methods of provision may change as necessary.
Article 4 (Cancellation and refunds)
Before painting begins, cancellations are handled after discussing them with you individually. Once painting has started, cancellations and refunds are not possible. Please see the Cancellation and Refund Policy page for details.
Article 5 (Changes after completion)
Because of the nature of the work, I cannot repaint or alter a piece after it is completed.
Article 6 (Copyright and use of the artwork)
Ownership of the artwork passes to you. The copyright remains with us.. Individual customers are welcome to display purchased artwork in their own home or personal space. Posting photos on SNS or blogs is welcome within personal use (we'd appreciate a credit such as "Artwork by Mermaid nao" if possible). Use by companies or businesses (store or office display, PR, commercial use, etc.) requires a separate quote and permission depending on the scope of use. Please refrain from unauthorized reproduction, modification, redistribution, or commercial use of the artwork.
Article 7 (Prohibited acts)
The following are prohibited: unauthorized reproduction, alteration, redistribution, or commercial use of the artwork; using the artwork as AI training data or similar without my permission; infringing the rights of the artist or any third party; and interfering with the operation of the Services.
Article 8 (Disclaimer)
Delivery dates may change due to unavoidable circumstances. In that case, I will contact you promptly. I am not responsible for damage caused by events beyond my control, such as natural disasters or shipping accidents. In addition, while I value expression that wholeheartedly affirms the person viewing the work, my works and services do not guarantee any particular effect, result, psychological change, or solution to a problem.
Article 9 (Changes to these terms)
These terms may be changed as necessary. If there are important changes, I will announce them on this site.
Article 10 (Governing law and jurisdiction)
These terms are governed by the laws of Japan. If a dispute arises regarding the Services, the court having jurisdiction over the artist’s location shall be the exclusive court of first instance.
